PROPERTY MANUMISSION PROPERTY LISTING CONSENT DECLARATION 1. CONSENT TO PROCESS PERSONAL INFORMATION I voluntarily provide my personal information to Property Manumission for the purpose of registering an account, listing or marketing property for sale or rental, communicating regarding property enquiries and administering property-related services. I understand that my personal information will be processed in accordance with the Protection of Personal Information Act, 2013 and other applicable South African laws. 2. IDENTITY VERIFICATION I confirm that the identity document uploaded during registration belongs to me and that all information supplied during registration is true, accurate and complete. I understand that false, misleading or fraudulent information may result in my registration or property listing being rejected, suspended or permanently removed. 3. AUTHORITY TO LIST PROPERTY I declare that: I am the lawful owner of the property; or I have been legally authorised by the property owner to market or manage the property; or I am an authorised estate agent or representative with permission to market the property. I accept full responsibility for proving my authority to list or market any property submitted through the platform. Where the property has more than one registered owner, I confirm that I have obtained the necessary authority and consent from all registered owners before submitting the property for listing. 4. ACCURACY OF PROPERTY INFORMATION I confirm that all property information supplied by me, including photographs, descriptions, prices, addresses, measurements, property features and ownership information, is accurate to the best of my knowledge. I understand that misleading, incomplete or false information may result in the listing being rejected or removed. 5. ADMINISTRATOR APPROVAL I understand that registration does not automatically grant access to list property. Property Manumission will review my registration, uploaded identity document and consent before approving or rejecting my account. Property Manumission reserves the right to approve, reject, suspend or delete any registration or account that does not comply with its requirements or applicable law. 6. PROPERTY LISTING APPROVAL I understand that all property listings may be reviewed by Property Manumission before publication. Property Manumission may approve, reject, edit, hide, suspend or remove a property listing where necessary to protect users, comply with the law or maintain the quality of the platform. Submission of a property does not guarantee publication. 7. CONFIDENTIALITY OF CONTACT INFORMATION I understand and agree that: My personal phone number will not be displayed publicly. My personal email address will not be displayed publicly. My uploaded identity document will not be displayed publicly. My consent record and electronic signature will remain confidential. My information will only be available to authorised Property Manumission administrators. The public website will display only Property Manumission contact information, including its telephone number, email address and WhatsApp contact. 8. PUBLIC DISPLAY OF PROPERTY INFORMATION I authorise Property Manumission to display and market the following information publicly: Property photographs Property descriptions Property price or rental amount Property type Property features Property size General location Publicly suitable property address information Other information necessary to market the property My personal contact details will remain confidential unless I separately authorise their disclosure. 9. COMMUNICATION CONSENT I authorise Property Manumission to contact me through: Email Telephone SMS WhatsApp Communication may relate to my registration, account, property listing, buyer enquiries, tenant enquiries, offers, viewings, property services and other relevant business communication. 10. BUYER AND TENANT ENQUIRIES I understand that buyer and tenant enquiries will initially be handled by Property Manumission. Property Manumission may contact me regarding interested buyers, tenants, viewings, offers, rental applications and other property-related matters. I understand that a buyer or tenant will not automatically receive my personal contact details. 11. PROPERTY REMOVAL I understand that I may request removal of my listing or delete it through my account, subject to any existing agreement, pending transaction, offer, rental application or legal obligation. Property Manumission may also remove a listing that violates platform rules or applicable law. 12. USE OF PROPERTY PHOTOGRAPHS I confirm that I own, created or have permission to use all photographs uploaded by me. I authorise Property Manumission to display, resize, compress and use the photographs for property marketing on its website and other approved marketing channels. 13. TRANSFERRING ATTORNEY The Seller, Property Owner and/or Authorised Estate Agent hereby agrees and consents to the sole and exclusive appointment of Baedile Mokgadi Attorneys Incorporated, Conveyancers, as the transferring attorneys to attend to and manage the registration of transfer of the property where a sale is concluded through Property Manumission or as a result of an introduction, enquiry, lead, viewing, offer or transaction facilitated by Property Manumission. The Seller, Property Owner and/or Authorised Estate Agent acknowledges and agrees that: Baedile Mokgadi Attorneys Incorporated shall be appointed as the exclusive transferring attorneys for the transaction. No other transferring attorney may be appointed in respect of such transaction without the prior written consent of Property Manumission and Baedile Mokgadi Attorneys Incorporated. This appointment is a material condition of listing and marketing the property through Property Manumission. The Seller, Property Owner and/or Authorised Estate Agent confirms that they have the legal authority to accept this appointment and, where applicable, to bind all registered owners of the property. Where there is more than one registered owner, the person submitting the listing confirms that all registered owners have agreed to this appointment. This appointment applies to any sale concluded directly or indirectly through a buyer, purchaser or interested party introduced through Property Manumission. The Seller, Property Owner and/or Authorised Estate Agent may be required to sign further conveyancing, mandate or transfer documentation requested by Baedile Mokgadi Attorneys Incorporated. The transfer shall remain subject to all applicable South African property, conveyancing, contractual and legal requirements. Nothing in this declaration authorises Property Manumission or any person to act contrary to a binding sale agreement, court order or applicable law. I confirm that I have read, understood and voluntarily accepted this transferring-attorney clause and that my electronic acceptance of this declaration constitutes my agreement to the appointment. 14. LIMITATION OF LIABILITY I understand that Property Manumission acts as an intermediary and property listing platform. Property Manumission does not guarantee that a property will be sold, rented, purchased or occupied. Property Manumission is not responsible for losses or disputes arising from false, incomplete or inaccurate information supplied by users. Property Manumission does not provide legal, conveyancing, financial, valuation or tax advice unless expressly stated in writing. 15. RECORD KEEPING I authorise Property Manumission to retain my registration information, identity document, consent record, initials, IP address, date and time of acceptance for verification, security, legal compliance and record-keeping purposes. Personal information will not be retained longer than reasonably necessary, subject to legal, contractual and operational requirements. 16. WITHDRAWAL OF CONSENT I understand that I may contact Property Manumission to request access to, correction of or deletion of my personal information, subject to legal and contractual obligations. Withdrawal of consent may result in the suspension or deletion of my account and property listings where the information is necessary to provide the service. Withdrawal of consent does not automatically cancel obligations relating to an existing offer, sale agreement, pending transfer, rental application, transaction or legal obligation. 17. ELECTRONIC SIGNATURE I understand that entering my initials and selecting the consent checkbox constitutes my electronic signature and confirms my acceptance of this declaration. I acknowledge that my electronic acceptance may be recorded together with the date, time, IP address and device information. I agree that the electronic record may be retained as evidence of my consent and acceptance. 18. FINAL DECLARATION I declare that: I have read the entire Property Listing Consent Declaration. I understand its contents. I voluntarily agree to its terms. All information supplied by me is true and accurate. I consent to Property Manumission processing my personal information. I have the legal authority to list and market the property submitted by me. I consent to the appointment of Baedile Mokgadi Attorneys Incorporated as the sole and exclusive transferring attorneys where applicable. I agree to comply with the Property Manumission Privacy Policy and Terms and Conditions. I understand that my electronic signature and consent record may be relied upon as evidence of my acceptance. MANDATORY ACCEPTANCE By entering my initials below and selecting the consent checkbox, I confirm that I have read, understood and accepted the entire Property Listing Consent Declaration, including the appointment of Baedile Mokgadi Attorneys Incorporated as the sole and exclusive transferring attorneys.
